BILLS OF EXCEPTION

A defendant is entitled to waive his or her right to appeal his or her conviction by a trial court. However, the waiver must be knowingly and intelligently made by the defendant. The waiver may only be made after the defendant's right to appeal has accrued.

After a defendant has retained a defense attorney or after the court has appointed a defense attorney for an indigent defendant, the defense attorney's duties begin.

CREDIT CARD OR DEBIT CARD ABUSE

A person commits the offense of credit card or debit card abuse when he or she presents a credit card or a debit card knowing that the card was not issued to him or her or that the card had expired or was revoked, uses a fictitious credit card or debit card with the intent to obtain a benefit, steals a credit card or a debit card knowing that it was stolen, buys a credit card or a debit card knowing that the person who is selling the card is not the cardholder, sells a credit card or a debit card without being the issuer, or signs or uses another person's credit card or debit card without the other person's consent. The offense may also be committed by possessing a credit card or a debit card that has not been issued to the person.

SEARCH & SEIZURE - SCHOOL SEARCHES

The protection of the Fourth Amendment of the United States against unreasonable searches and seizures did not traditionally apply to searches of students in schools because school officials are not law enforcement officials and because they are given permission to act on behalf of the students' parents while the students are in school. The law in this area changed in 1985 when the United States Supreme Court held that school officials act as representatives of a state when they conduct searches and that the Fourth Amendment applies to searches by the school officials on school property.

Informants

An informant is an individual that provides law enforcement officers with information about an individual or a criminal activity. Informants may be sought out by law enforcement officers or may just be present at the time that a crime occurred. There are numerous types of informants.
