New Jersey Workers Compensation
Proudly serving workers compensation clients in Union, Essex and Middlesex counties, NJ
An injury at work has many consequences. Not only are you unable to work and pay your bills, but also your relationship with your employer may be at stake.
Rispoli, Borneo & Suthard, PC is a widely respected workers compensation law practice in Union, Essex, and Middlesex counties. We have helped countless New Jersey employees hurt or sickened in the workplace apply for and receive workers compensation benefits.
Three types of benefits are paid under New Jersey’s workers compensation system:
Temporary disability—Payments equal to 70 percent of your average weekly wage are paid as long as your employer’s insurance company doctor says you cannot return to work.
Medical benefits—Your employer’s insurer pays for all authorized medical treatment by the insurer’s doctor.
Permanency award—For a permanent disability, a settlement is paid based on the percentage of disability suffered, as agreed on by the insurance company’s doctor and your personal physician.
Injured workers are supposed to quickly receive disability assistance, medical care, and wage replacement benefits, regardless of the employer's fault for the injury. In fact, under workers compensation law, you do not have to prove that your employer did anything wrong, only that you were injured in the course of your employment.
This arrangement is designed to avoid drawn-out lawsuits by workers against employers to get the money they need immediately. Yet, quite often, the employer or insurance carrier contests the payment of benefits or refuses to provide needed medical care.

Seeking every recourse to benefit clients
Quite often, workers compensation is not the only solution. In many instances, someone other than the employer shares responsibility for an injury, such as a building owner, subcontractor, product manufacturer or designer, or another driver. If another person or company helped bring about a workplace injury or illness, we apply our knowledge of personal injury and negligence law to pursue those parties for recovery above and beyond workers compensation benefits.
