Under certain circumstances, you can pursue both a worker’s compensation claim and a personal injury claim. That occurs when your injury was caused by the negligence or fault of somebody other than your employer. What we refer to as a third party. The easiest way to think about this is by way of an example. Let’s pretend that you are a delivery driver and you’re out in the delivery and you’re involved in a motor vehicle accident. You would have both a worker’s compensation claim against your employer and you would be able to pursue a personal injury claim against the driver that caused the accident. So you would have both a workers’s compensation claim and a third party claim in that instance.
